Change of employer

Change of employer used to be a bit easier prior the Novelization of the immigration law in 2021. Let's have a look at this matter and all the deadlines connected to it.





Who does it concern?

Every holder of Employee or Blue card who does not have free access to the Labour market must go through the process of change of employer/position, in case they change employer or position to anything different than mentioned in the Vacancy connected to their permit.


What are the deadlines?


3 DAYS

- Holders of Employee card and Blue card who have free access to the Labour market must only report the change within 3 days from starting the new job.


30 DAYS

- The beginning of work cannot start sooner than 30 days from when the application for the change of employer is submitted.

- 30 days is the longest the Vacancy must stay in the Labour office database prior submitting the application. In case of higher positions/salaries, it may also take 10 days only.


60 DAYS

- This is how long the overall process takes.

- The application for the change of employer (or purpose) must be submitted no later than 60 days from the last day of employment. It should therefore be initiated as soon as handing in/receiving the notice.


6 MONTHS

- The application cannot be submitted the first 6 months of the first Employee card, unless the foreigner was laid off for certain reasons.


2 YEARS

- Once Blue card holder reaches 2 years of stay, he/she gains a free access to the Labour market and does not have to go through the process of the change of employer. It is only required to report the change to the Ministry of Interior within 3 days from the start of work.
